Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Botsfolio ("Botsfolio", "we", "us", or "our") and govern your access to and use of the Botsfolio website, applications, and services (together, the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Service. You may not use the Service if you are barred from doing so under the laws of your country or any applicable sanctions or trade-control regime. By using the Service you represent that you meet these requirements.

2. What Botsfolio is, and is not

Botsfolio is an educational and informational tool. It describes market structure, shows how chart patterns have behaved historically, presents backtested statistics, and lets you ask questions about markets and about trade history you choose to share. That is the entire purpose of the Service.

Botsfolio does not, and is not intended to:

  • provide financial, investment, legal, tax, or accounting advice;
  • recommend that you buy, sell, hold, enter, or exit any asset or position;
  • manage your money, execute trades, or act as a broker, dealer, exchange, or adviser;
  • act as your agent or fiduciary, or create any advisory or fiduciary relationship.

Nothing on the Service is a solicitation or offer to buy or sell any financial instrument. Every decision you make is your own.

3. No financial advice

Any content, setup, chart, statistic, metric, message, or output from the Service is general information only and is not tailored to your personal circumstances, financial situation, risk tolerance, or objectives. You are solely responsible for your own trading and investment decisions and for evaluating the merits and risks of any decision. You should seek advice from a licensed professional before making financial decisions.

4. Risk disclosure and hypothetical results

Trading cryptocurrencies and other assets, particularly with leverage or derivatives, carries a high level of risk and can result in the loss of some or all of your capital. Prices are volatile and past behavior does not predict future results.

Backtested, simulated, and hypothetical performance shown in the Service has inherent limitations. Unlike an actual record, simulated results do not represent real trading, are prepared with the benefit of hindsight, and do not account for all real-world factors such as slippage, liquidity, execution, and changing market conditions. No representation is made that any account will or is likely to achieve results similar to those shown. Statistics are estimates based on the data available to us and may contain errors.

5. Your responsibilities

  • You use the Service at your own discretion and risk.
  • You are responsible for your own trades, positions, and outcomes.
  • You are responsible for complying with all laws that apply to you, including tax and reporting obligations.
  • You are responsible for keeping your account credentials and any connected accounts secure.

6. Accounts and security

Some features require an account. You agree to provide accurate information, to keep it up to date, and to keep your login credentials confidential. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe present a security, legal, or abuse risk.

7. Your data and uploads

You may choose to upload a trade-history file or connect a third-party account so the Service can analyze your own record. You grant us a limited license to process that data to provide the Service to you. We handle your data as described in our Privacy Policy. You represent that you have the right to share any data you provide.

8. Third-party services

The Service may integrate with or link to third parties, such as cryptocurrency exchanges, authentication providers, messaging platforms, support tools, and AI providers. We do not control and are not responsible for third-party services, their availability, accuracy, or their terms and privacy practices. Your use of a third-party service is governed by that third party's terms. Where you connect an exchange, you are responsible for the permissions you grant; we request read-only access where possible and never place trades.

9. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or in violation of any applicable regulation;
  • scrape, harvest, resell, or redistribute our content, data, or metrics without permission;
  • reverse engineer, decompile, or attempt to extract the source or models behind the Service;
  • interfere with, overload, or attempt to gain unauthorized access to the Service or its systems;
  • use bots, automation, or evasion techniques to exceed usage limits or abuse free access;
  • misrepresent the Service's output as personalized advice or as a recommendation from us.

10. Intellectual property

The Service, including its software, content, design, text, and the branded metrics, statistics, and analyses we produce, is owned by Botsfolio or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes. All rights not expressly granted are reserved.

11. Fees and changes to the Service

Parts of the Service are offered free of charge, subject to usage limits, and parts may require payment. We may introduce, change, or discontinue features, limits, or pricing at any time. We may modify or discontinue the Service, in whole or in part, without liability to you.

12. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free operation. We do not warrant that any information, setup, statistic, or output is accurate, complete, current, or reliable, or that the Service will meet your requirements.

13. Limitation of liability

To the maximum extent permitted by law, Botsfolio and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading or investment losses, arising out of or related to your use of, or inability to use, the Service, whether based on contract, tort, negligence, strict liability, or any other theory, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred US dollars (USD 100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Botsfolio and its owners, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses, including reasonable legal fees, arising out of your use of the Service, your trading or investment decisions, your data or uploads, or your breach of these Terms or of any law or third-party right.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including a breach of these Terms. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the date above. Continued use of the Service after changes take effect means you accept the revised Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state courts located in Hamilton County, Indiana, and the United States District Court for the Southern District of Indiana, and you waive any objection to those venues. To the extent permitted by law, any claim must be brought individually and not as part of a class or representative action.
